The following Terms and Conditions apply to users, viewers and all people who have access to www.thesheddistillery.com (this “site”).

By entering this Website you agree to be bound by the Terms and Conditions, which shall take effect immediately on your first visit of the Website.

Please read the Terms and Conditions carefully before accessing and using the Website.

This Website is operated by PJ Rigney Distillery & International Brands Ltd, t/a The Shed Distillery, a private company registered in Ireland and having its registered office at The Food Hub, Drumshanbo, Co. Leitrim, Ireland, N41 WR22.

1. ACCESSING OUR SITE

To access this website you must be of legal drinking age in the country where you reside. Please exit this Website immediately if you are not of a legal age for consuming alcoholic beverages in the country or territory in which you reside, or are in a country or territory where the access to this Website is not permitted.

Access to this Website is permitted on a temporary basis and we reserve the right to withdraw, suspend or amend the services we provide on the Website without notice. This Website changes and is updated regularly and The Shed Distillery will not be liable if for any reason the Site or any materials on it are unavailable at any time or for any period.

2. INTELLECTUAL PROPERTY RIGHTS

Material from this Site may not be modified, copied, reproduced, republished, distributed, posted, uploaded, or transmitted in any way without the prior written consent of The Shed Distillery. The Shed Distillery is the owner or licensee of all intellectual property and database rights in the Site and in material published on it, including but not limited to trademarks, logos, designs, images, text, video and audio materials, look and feel and software. All such rights are reserved. Neither title nor intellectual property rights are transferred to you by use of or access to this Site; rather, all rights, title and interest in and to all aspects of the Site remain the property of The Shed Distillery. Material on this Site is provided for lawful purposes only.

3. NO LIABILITY

To the fullest extent permitted by law, under no circumstances shall The Shed Distillery be liable for any loss, cost or damage (direct, indirect, consequential, or otherwise including lost profits, loss of income or revenue, business interruption, loss of goodwill or loss of data or information or special or punitive damages) suffered by you as a result of your use of the site or from any computer virus transmitted through the site, or other sites accessed from the site, regardless of whether such loss, cost or damage arises from our negligence or otherwise, and regardless of whether we are or have been expressly informed of the possibility of such loss or damage. Nothing in these Terms and Conditions excludes The Shed Distillery’s liability for death or personal injury arising from its negligence, nor its liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any liability which cannot be excluded or limited under applicable law.

4. MATERIALS SUBMITTED BY YOU

By submitting any remarks, questions, ideas, suggestions graphics, creative concepts, or other information (collectively the “Submission”), you agree to grant The Shed Distillery a non-exclusive licence to use that Submission. Although you will still own the copyright in your Submission, The Shed Distillery will have the right to freely use, edit, alter, reproduce, publish and/or distribute the material contained in your Submission. This licence will be free of charge, perpetual and capable of sub-licence. The Shed Distillery will not be required to treat the Submission as confidential, and will not be liable for any use whatsoever or disclosure of the Submission, and need not provide any compensation or acknowledgement for the Submission. The Shed Distillery may exercise all copyright and publicity rights in the material contained in your Submission in all jurisdictions, to their full extent and for the full period for which any such rights exist in that material. You must ensure that your Submission does not infringe any copyright, database right, trade mark or other intellectual property right of any other person and that it does not contain any unlawful, threatening, defamatory, libellous, obscene, pornographic or profane material that could constitute or encourage criminal or unlawful conduct or would tend to encourage or promote irresponsible alcohol consumption (collectively the “Inappropriate Material”). By submitting your Submission, you are warranting that you have the right to grant The Shed Distillery the non-exclusive copyright licence described above and that it does not contain any Inappropriate Material. If you are not in a position to grant such a licence or to warrant that it does not contain Inappropriate Material, please do not submit the Submission. The Shed Distillery will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our Site. We have the right to remove any material or posting you make on our Site if, in our sole opinion such material does not comply with our standards.

5. INDEMNITY

You will indemnify, defend and hold The Shed Distillery harmless from and against any and all claims, actions, demands, causes of action and other proceedings arising from or related to any of the following (the “Claims”): (1) your use of, inability to use, or activities in connection with the Site; (2) any violation of these Terms of Use or any other Company terms, conditions or policies by you or through any account you may have with any Website; (3) any transaction; (4) any allegation that any Submission or other materials that you make available through the Website infringe or otherwise violate the intellectual property, privacy, or other rights of any third party; or (5) your violation of any rights of any Website visitor, user, or customer, or any other third party; and you agree to reimburse The Shed Distillery on demand for any damages, losses, costs, judgments, fees, fines and other expenses we incur as a result of any Claim(s).

6. LAW & JURISDICTION

These terms and conditions (including the privacy and cookies policy) shall be governed in accordance with the laws of Ireland, notwithstanding any principles of conflicts of law. Any dispute arising from these Terms and Conditions will be submitted to the exclusive jurisdiction of the Irish courts, although this does not affect The Shed Distillery’s right to bring proceedings against you for breach of these terms and conditions in your country of residence or any other relevant country. Except as described otherwise, all materials in this Site are made available only to provide information about The Shed Distillery and its products. The Shed Distillery controls and operates this Site from the Republic of Ireland and makes no representation that these materials are appropriate or available for use in other locations.

7. INFORMATION ABOUT YOU AND YOUR VISIT TO THE SITE

The Shed Distillery processes information about you in accordance with its Privacy Statement, which is available here privacy policy. By using the Site, you consent to such processing and you warrant that all information provided by you is accurate and up-to-date.

Except as otherwise expressly stated by The Shed Distillery on the Website, The Shed Distillery is not affiliated or associated with operators of any third party websites that link to or are linked from the Website. Company expressly disclaims any responsibility for the accuracy, content, or availability of information found on third party websites that link to or are linked from the Website. We cannot ensure your satisfaction with any products or services that are available through any third party site that links to or is linked from the Website because these third party sites are owned and operated by independent entities. We do not endorse any of the products or services, nor have we taken any steps to confirm the accuracy or reliability of any of the information, made available through any third party sites. We make no representations or warranties as to the security of any information (including without limitation credit card or other payment card and other personal information) that you may provide or be requested to provide to any third party, whether through such a third party site or otherwise.

The Shed Distillery shall have the right, at any time and at its sole discretion, to block links to the Website through technological or other means without prior notice.

You must not misuse our Site by knowingly introducing and malicious code (including viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful). You must not attempt to gain unauthorised access to our Site, the service on which the Site is stored and/or hosted or any server, computer or database connected to our Site. You must not attack this site via a denial-of-service attack or a distributed denial-of-service attack.

The Shed Distillery will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect computer equipment, computer programs, data or other proprietary material due to your use of the Site or to your downloading of any material posted on it, or any website linked to it.

10. MISCELLANEOUS

Products and promotions of The Shed Distillery are produced and available in many parts of the world. However, this Site may describe products, promotions or contests that are not available in your country or state of domicile. If any provision of these Terms and Conditions shall be deemed to be unlawful, void or for any reason unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. The Shed Distillery can revise these Terms and Conditions or the content of the Site at any time by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms and Conditions to which you are bound.

12. VISITING THE SHED DISTILLERY

Ticket Purchasing

These terms set out the basis on which you can purchase tickets for your visit to The Shed Distillery. The management reserves the right at all times to refuse admission.

By purchasing tickets for The Shed Distillery you acknowledge that you have read and agree to be bound by and subject to the following Terms and Conditions and have read and agree to the use of the information you provide us with.

Once your tickets have been purchased, the ticket is non- refundable and non-changeable at the absolute discretion of The Shed Distillery. All prices are quoted in Euro. Whilst we reserve the right to increase or decrease our prices at any time before you book, once your booking is confirmed the price of your booking as stated in the confirmation email will not be altered.

We will use all reasonable endeavours to ensure that The Shed Distillery and all of its exhibits/displays are open for use by visitors during normal opening hours. However, The Shed Distillery reserves the right, in its absolute discretion, whether for safety reasons or otherwise and with or without prior notice to close The Shed Distillery or any part of it. In the event of such closure, The Shed Distillery will refund any visitor the cost of his or her prepaid ticket. Otherwise The Shed Distillery shall have no liability whatsoever, including no liability for travel expenses or any other out of pocket expenses in respect of closure of part or all of The Shed Distillery.

From time to time The Shed Distillery or other authorised third parties may carry out photography or other recording at the venue and any images or recordings may feature visitors. Visitors consent to the use of such images by The Shed Distillery in connection with advertising, promotions or monitoring and acknowledge that the copyright in such images rests with The Shed Distillery and/or any authorised third party.

The Shed Distillery is suitable for visitors under 18 years of age. Children under the age of 18 must be accompanied by an adult aged 18 or above whilst visiting The Shed Distillery. Children under the age of 18 are permitted to visit The Shed Distillery where alcoholic beverages will be available but they will not be served alcohol and/or allowed to consume alcohol.

Pets or animals (with the exception of guide dogs and hearing dogs) are expressly prohibited within The Shed Distillery.

VISITOR RULES OF CONDUCT

The Shed Distillery reserves the right, in its absolute discretion, to refuse entry on to or remove from its premises or the vicinity any person who:

  • Has been convicted of a criminal offence, which, in the opinion of The Shed Distillery is likely to affect the safety or enjoyment of other visitors
  • Is behaving in a manner, which, in the opinion of The Shed Distillery has, or is likely to affect the safety or enjoyment of other visitors, cause annoyance to other visitors, behaving in such a way as to cause danger or distress to others or damage the property
  • Has used threatening, abusive or insulting words or behaviour or in any way provokes or behaves in a manner which may provoke a breach of the peace
  • Is thought to be under the influence of alcohol or other substances

In addition to the foregoing, where a person has caused damage he/she must meet any expenses incurred as a result of such behaviour.

All persons entering The Shed Distillery must pay for admission. Tickets must be retained at all times and submitted for inspection if required by any employee of The Shed Distillery. Any person attempting to gain admission without a valid ticket shall be asked to leave.

In accordance with Irish Law, smoking is strictly prohibited within The Shed Distillery.

The Shed Distillery reserves the right to prosecute any persons found damaging or defacing any part of the premises.
